OAR Spring Legislative Conference Reception |
|
|
|
| |
|
Nine people represented YCAR at the OAR Spring Legislative Conference in Columbus from April 29 to May 1st: OAR President Tom Williams, Sandi Bates, Charley Althof, Debbie Parisi, Joe Zidian, Debbie Schiffhauer, Wes Chandler, Debbie Barber, and David Klacik. Starting with the opening lunch on Monday, members attended meetings relative to their service on OAR committees, including: Legal Issues, Communications, Professional Development, Enlarged Legislative, Local Government, Finance, Member & Director Forum, Executive Committee, RPAC, Association Executives, Legislative Briefing, and the Board of Directors meeting at the conclusion of the conference.
While there, they met with our legislators at a statehouse reception and a dinner afterwards, which also included members of WABOR.

Banks Increasingly Turning to Deeds-in-Lieu of Foreclosure |

Short sales and loan modifications have grown to help offset foreclosures, but banks are also turning to deeds-in-lieu of foreclosure more too. Slightly above 20,000 deeds-in-lieu of foreclosure occurred nationwide in 2012, which is up nearly 40 percent from 2011, according to RealtyTrac.
Some states are even seeing larger increases. For example, deeds in lieu of foreclosure skyrocketed 76 percent year-over-year in California, 53 percent in Nevada, and 49 percent in Florida.
Deeds-in-lieu of foreclosure permit a lender to take possession of a home without having to undergo the foreclosure process. The home owner is allowed to leave their mortgage debt and avoid foreclosure by turning over the home to the bank. Often times, a deed- in-lieu of foreclosure offers “cash for keys,” providing a cash payment to the distressed home owner in order for them to vacate the home, without letting the home fall into foreclosure.

Does Ohio law require disclosure of a murder or suicide? |

It
seems as if every week a broker calls the OAR Legal
Assistance Hotline with the following question: Does
Ohio law require me to disclose to a buyer that a murder
or suicide took place on a property?
Here’s the answer we always give: Ohio law requires
sellers and real estate licensees to disclose latent
defects concerning
the physical condition of the property of which they
have knowledge. In the case of a murder or suicide, this
event rarely affects the physical condition of the
property and doesn’t constitute a latent defect.
It could, however, be considered to be a material
fact that
Ohio law also requires be disclosed. So what’s a
material fact? It’s a fact that could impact a
buyer’s decision to purchase the property or the terms
on which they purchase the property. While some buyers
may not consider a murder or suicide to be material
others may.
Because this could be a material fact to some buyers,
to avoid a potential lawsuit it is prudent to err on the
side of caution and to disclose the murder or suicide to
a buyer. The agent needs to discuss this issue with the
seller and obtain his/her consent before doing so,
however. Such consent from the seller and the disclosure
to the buyer should be done in writing and should be
made before the buyer is bound by a purchase agreement.
If the seller will not permit disclosure of the event,
the broker will need to determine if taking the listing
is worth the risk of potentially having to defend a
lawsuit by the buyer for failing to disclose what the
buyer will allege was a material fact.
The last thing I usually tell brokers is that it’s
never a question about whether or not the buyer will
find out about the murder or suicide…it’s just a
question of whether they will learn about it from you
before they buy the house or from the next door neighbor
afterwards. And trust me, buyers are always more upset
when it’s the latter.

Tax benefits may await Ohio REALTORS who incorporate |

Did
you know that Ohio law permits agents to have their
commissions paid to a corporation or other legal
entity? Ohio License law was changed several years ago
to permit this so REALTORS could take advantage of any
tax benefits that may exist by incorporating or
forming an LLC.
While the small business tax deduction that was in
the Governor’s original budget was taken out by the
House, the idea may not be totally dead as some
members of the Ohio Senate have expressed interest in
reinserting a version of a targeted cut into its
version of the plan. Either way, REALTORS who
haven’t formed such an entity should definitely
consider doing so.
Below are some of the key aspects of the license
law provisions you need to know as an agent or as a
broker whose agents want to form a separate entity:
- A licensee’s commissions
can be paid to either a partnership, association,
limited liability company, limited liability
partnership or a corporation in which the licensee
has an ownership interest or is an officer.
- There is no minimum amount of stock or other
ownership interest that an agent must own.
Unlicensed persons such as a licensee’s spouse
or children can also have an ownership interest in
an entity to which commissions are paid.
- Agents are not relieved from personal civil
liability by incorporating. Prior to paying an
agent’s commission to such an entity, the broker
is required to verify that the agent is either an
officer or has some ownership interest in the
legal entity to which they want their commissions
paid. The broker also must keep a record of this
verification for a period of three years along
with the following additional information:
- The name of the licensee
who earned the commission, fee or other
compensation;
- The amount paid; and
- The name of the entity to
which it was paid
- Examples of verification would be:
- A copy of the articles
of incorporation listing the agent as an
officer;
- A copy of a stock certificate demonstrating
an ownership interest;
- A copy of the partnership or association
agreement;
- A copy of the articles of
organization for an LLC
- Although not required by
statute, a broker may want to ask the agent for a
copy of the entity’s authorization to do
business in Ohio and ask the agent to sign a
statement that they:
- Are an officer,
stockholder, etc.;
- That the legal entity is authorized to do
business in the state of Ohio;
- That the entity is properly registered and
in good standing;
- That the entity and any unlicensed owners of
that entity will not engage in any activity
that requires a real estate license;
- That they will notify the
broker if any of that information changes or
is no longer true (i.e., the agent no longer
has an ownership interest, the entity is not
in good standing, etc.)

Pending Home Sales Index for Ohio |

The Ohio Association of REALTORS reports that the number of
single family homes and condominiums put under agreement in March rose for
the 23rd consecutive month compared to the results from the prior year.
“With each passing month, it’s becoming more evident that the Ohio
housing marketplace is making significant progress in its
on-going recovery from the economic collapse that shook the very foundation of the American
Dream,” said OAR President Thomas J. Williams. “Throughout the state, buyers remain eager
to take advantage of the ideal conditions that exist, with historic low interest rates,
favorable pricing and an understanding that, long-term, home ownership is a smart
investment.”
Ohio’s March Pending Home Sales Index of 134.6, a
forward-looking indicator based on contract signings, rose 10.8 percent from the March 2012 index score of 121.4.
An index of 100 is equal to the average level of contract activity during 2008, which marked
the end of five consecutive record years for existing home sales and the onset of the
recession. Activity levels in 2008 are reflective of a historically healthy, balanced market. Our
March 2013 pending sales index of 134.6 marks a 34.6 percent increase from the benchmark
March 2008 index of 100. Additionally, the current results also best the PHSI marks posted
during the month in Ohio in 2009 (87.1), 2010 (117.9) and in 2011 (105.7).
A pending sale or a sale “under agreement” is when the buyer and seller agree on terms of
the sale of a home and have a signed purchase and sale agreement, but have yet to close
and be recorded as such.
OAR, the largest professional trade association in the state with 26,000 members, is the only
organization that compiles this statewide information from selected Multiple Listing Services
each month. The tracking of “pending sales” provides reliable information about where the
market is heading in coming months. |

YCAR Offers Quarterly
Dues Payment Service |
|
|
|
|
|
In order to relieve the
financial strain of paying your annual REALTOR® dues on
December 1st (during the holiday season), the Youngstown
Columbiana Association of REALTORS® will continue to
offer a voluntary quarterly dues payment service in
2013.
The quarterly dues payment service is
available for members who have already paid their 2013
dues and wish to begin paying ahead their 2014 dues.
How
to Pay Your 2014 Dues Ahead...
By March 1, 2013,
remit a payment of $141.75 By June 1, 2013, remit a
payment of $141.75 By September 1, 2013, remit a
payment of $141.75 By December 1, 2013, remit a
payment of $141.75
Advance dues payments in
amounts different than the quarterly payments outlined
above will also be accepted (minimum $100.00). You will
receive a 2014 dues invoice with any adjustments to your
balance on November 1, 2013 with the remaining portion
of your 2014 dues payment due by December 1, 2013.
If
you choose to take advantage of this quarterly dues
payment service, but by December 1, 2013 you decide not
to continue your REALTOR® membership for 2014, your
entire 2014 advance dues payment will be refunded.
